  • When you place an order to buy goods, a binding contract is formed at that moment. You are committed to your order and must complete payment.
  • There is no statutory right to cancel an order once placed, as the goods we sell are dependent on fluctuating financial market prices.
  • You can request to terminate an order before it is dispatched, but this is at our discretion and will incur fees, including a termination fee and a market loss fee to cover any fall in the metal price.
  • You must not accept or sign for any delivery if the package appears damaged, tampered with, or resealed. You should instruct the courier to return it to us.
  • We cannot accept liability for loss after a package has been signed for or confirmed as delivered to the address provided, including houses of multiple occupancy, work addresses, or PO boxes.
  • We may require ID verification to comply with Anti-Money Laundering (AML) regulations. Goods will not be dispatched until this is complete.

1. Definitions and Interpretation

The definitions and rules of interpretation in this clause apply to these terms.

  • “You/Customer”: The person purchasing goods or services from the Supplier.
  • “We/Us/Supplier”: Bullion Exchange, registered at 128 City Road, London, United Kingdom, EC1V 2NX (Company Number: [Your Company Number]).
  • “Goods”: The bullion coins, bars, or other items that the Supplier is to supply to the Customer.
  • “Contract”: The contract between you and us for the sale and purchase of Goods, which incorporates these terms.
  • “Market Loss Fee”: A fee covering the negative difference in the underlying metal price from when an order was placed to when it is terminated.
  • “Termination Fee”: A discretionary administrative fee charged for processing an order termination.
  • “Working Day”: Monday to Friday, 8:30 am to 5:00 pm, excluding UK public holidays.

2. Basis of Contract

2.1. The Contract between you and us is formed the moment you place your order, whether online or by phone. By placing an order, you agree to be bound by these Terms and Conditions.

2.2. Our acceptance of your order is conditional upon the preconditions being met, including (i) receipt of cleared funds, and (ii) satisfactory completion of any required ID verification checks under AML regulations.

2.3. We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to, orders with pricing errors or those suspected of being fraudulent. If we cancel an order, a full refund will be provided.

3. Price and Payment

3.1. Prices for Goods are “live” and based on fluctuating precious metal markets. The price is fixed for you at the moment you place your order.

3.2. Payment must be made promptly after an order is placed. We accept payment via Bank Transfer and Debit/Credit Card, subject to order value limits and security checks.

3.3. All payments must originate from an account registered in your own name. We do not accept payments from third parties for your order.

4. Cancellation and Termination

4.1. As the price of all Goods is dependent on financial market fluctuations beyond our control, you have no statutory right to cancel your order under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

4.2. In exceptional circumstances, we may, at our sole discretion, agree to terminate your order. If we agree, you will be liable for a Termination Fee plus any applicable Market Loss Fee. These fees will be deducted from any refund due.

5. Delivery

5.1. We will dispatch Goods to the delivery address provided in your order. For card payments, this must be the card’s registered billing address.

5.2. Delivery is made by a fully insured, tracked courier. A signature is required upon receipt. Ownership of the Goods passes to you once the package is signed for or confirmed as delivered by the courier at the specified address.

5.3. IMPORTANT: You must not accept or sign for any package that appears to be damaged, opened, resealed, or tampered with. You should refuse the delivery and instruct the courier to return the package to us, and notify us immediately.

5.4. We accept no liability for loss or theft if a package is delivered to a shared address, house of multiple occupancy, business address, PO Box, or mail-forwarding service once it has been signed for or confirmed as delivered by the courier.

5.5. Any delivery dates quoted are approximate. We are not liable for delays outside of our control (e.g., courier issues, adverse weather).

6. Damaged or Incorrect Goods (Warranty)

6.1. We warrant that Goods will be of satisfactory quality. If you receive an item that is incorrect, faulty, or damaged (unrelated to transit damage covered in clause 5.3), you must notify us in writing at info@bullion-exchange.co.uk within 24 hours of receipt.

6.2. We will provide instructions for returning the item. Upon inspection, we will either replace the Goods or issue a full refund at our discretion.

7. Buy-Back Service

7.1. We may, at our sole discretion, offer to purchase Goods from you that were originally purchased from us. This is not a returns service but an offer to buy at the current market rate. Please contact us to enquire about this service.

8. Legal and Compliance

8.1. Anti-Money Laundering (AML): We are required by law to conduct customer due diligence. We may require you to provide proof of identity and address. To do this, we may use third-party agencies to verify your details. This is an identity check, not a credit check, and will not affect your credit rating.

8.2. International Orders: For orders outside the UK, you are the “importer of record” and are responsible for all import duties, taxes, and customs fees. You must comply with all laws of the destination country.

9. Limitation of Liability

9.1. Nothing in these terms limits our liability for death or personal injury caused by our negligence or for fraud.

9.2. Our total liability to you for any breach of these terms shall be limited to the total amount paid by you for the order in question.

9.3. We provide no investment or tax advice. The value of precious metals can fall as well as rise, and you should conduct your own research before purchasing.

10. General

10.1. These terms constitute the entire agreement between you and us.

10.2. This Contract is governed by the laws of England and Wales, and the English courts have exclusive jurisdiction over any disputes.
